GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern the sale of merchandise by Robert-Leslie LLC, a limited liability company of the State of Delaware, located at 4147 N. Ravenswood, Suite 301, Chicago, IL 60613 (“ROBERT-LESLIE PUBLISHING” or “we”) to you through www.dillystreehouse.com or investigatorkidsclub.com (the “Website”). The Website is available only for purchases or subscriptions within the United States. Your use of the Website to purchase merchandise or subscriptions indicates your agreement to follow and to be bound by these General Terms and Conditions of Sale.

ORDERS

All orders are subject to written acceptance by ROBERT-LESLIE PUBLISHING. All orders will be confirmed by ROBERT-LESLIE PUBLISHING, in writing, by e-mail. Merchandise displayed on the Website may be out-of-stock or discontinued.

PRICES

All prices are in US Dollars. Prices may change without notice from time to time. The total amount due is inclusive of sales tax applied in accordance with applicable  state and local regulations based  on your shipping address. The applicable sales tax amount is indicated on the payment page of the Checkout.

The amount of sales tax charged on your order will depend upon various factors, including type of item purchased, sales price and destination of the shipment. Sales tax regulations may change between the time you place an order and the time of credit card charge authorization and this may affect the calculation of sales taxes. The amount appearing on your payment page of the Checkout may differ from the sales taxes ultimately charged as indicated in the invoice you will receive with the shipping confirmation e-mail.

All prices are inclusive of customs and import duties.

YOU ACKNOWLEDGE THAT CERTAIN PRODUCTS ARE NOT DESIGNED, MANUFACTURED OR INTENDED FOR USE BY CHILDREN UNDER THE AGE OF THREE (3) AND MAY CONTAIN SMALL PARTS. IN ADDITION TO ALL OTHER LIMITATIONS AND DISCLAIMERS IN THIS AGREEMENT, ROBERT-LESLIE PUBLISHING SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY, IN WHOLE OR IN PART, FOR ANY CLAIMS, LIABILITY, DAMAGES, LOSS OR COSTS ARISING FROM SUCH USE.

DISCOUNTS AT CHECKOUT

Checkout discounts are personalized codes, also referred to as DILLY’S TREE HOUSE CODES, which allow you to take advantage of a one-time discount on your total subscriptions order on the Website.

The DILLY’S TREE HOUSE CODE box is displayed on the first page of the Checkout: after you have inserted your subscriptions in the Shopping Cart and entered your code, press New Total.

 

Restrictions to the use of checkout discounts:

 

  1. The checkout discount applies to your entire order and can be used only once.
  2. The checkout discount cannot under any circumstances be exchanged for money.
  3. You may not use more than one checkout discount per order
  4. The checkout discount can be applied only to subscription plans with a higher checkout than the discount itself.

 

WE RESERVE THE RIGHT TO REFUSE ORDERS FOR ANY REASON WITHOUT EXPLANATION.

SHIPPING COSTS

ROBERT-LESLIE PUBLISHING from time-to-time offers FREE SHIPPING on certain subscription plans. Purchases not eligible for free shipping are subject to additional shipping and handling charges. Subscriptions to Alaska, Hawaii, and US territories and possessions are subject to a $4.95 shipping and handling surcharge, whether free shipping is included or not. Applicable shipping and handling rates are provided during the checkout process.

SHIPMENTS AND DELIVERY

You bear all risk of loss and damage to the merchandise that has cleared ROBERT-LESLIE PUBLISHING’S fulfillment house. Delivery is deemed complete and title to the merchandise passes to you upon acceptance of shipment by a common carrier.

CANCELLATION

All subscription plans will automatically renew on their renewal dates. You may cancel your automatic renewal at any point up to 30 days prior to the auto-renew date by emailing [email protected].

SUBSCRIPTIONS

All subscriptions are paid upfront and automatically renew. Month-to-month subscriptions are billed to your credit card monthly and auto-renew each month. They may be cancelled any time prior to 30 days before the next shipment. The full amount of 3-, 6-, and 12-month subscriptions are billed to your credit card when the first box ships and thereafter on the auto-renewal date unless the subscription is cancelled or changed prior to 30 days before the renewal.

DISCLAIMERS AND LIMITATIONS OF LIABILITY

ROBERT-LESLIE PUBLISHING MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE PRODUCTS INCLUDED IN THE WEBSITE NOR AS TO THE MERCHANDISE BEING SOLD TO YOU. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, ROBERT-LESLIE PUBLISHING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT, AND THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, WHICH EXTEND BEYOND THE DESCRIPTION OF THE MERCHANDISE CONTAINED ON OUR ORDER CONFIRMATION. ROBERT-LESLIE PUBLISHING WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE WEBSITE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES.

BINDING AGREEMENT

ROBERT-LESLIE’S order confirmation and these General Terms and Conditions of Sale shall be deemed the final and integrated agreement between ROBERT-LESLIE and you on the matters contained in these General Terms and Conditions of Sale.

GOVERNING LAW AND CHOICE OF FORUM

The laws of the State of Delaware (without giving effect to its conflicts of law principles) govern all matters arising out of or relating to these General Terms and Conditions of Sale, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these General Terms and Conditions of Sale shall be brought solely in the City of Chicago, State of Illinois.

SEVERABILITY

If any provision of these General Terms and Conditions of Sale is determined to be invalid, illegal or unenforceable, the remaining provisions of these General Terms and Conditions of Sale remain in full force to the extent permitted by law.

ROBERT-LESLIE PUBLISHING reserves the right to change these Terms and Conditions from time to time without notice.

PRIVACY

The terms and conditions of our Privacy Policy govern the processing of all personal data collected from you in connection with your purchase of merchandise through the Website.
